I had hoped that *I* could be there to see it. I actually would rather see Asaf Nass's trial, since he's the one who boldly lied to my face (ear?) on the phone at delivery, telling me there was no such thing as the 110% rule.

Brandi Aycock's trial is set to begin August 20th. Of course, that may change, because she could decide to do the same as her boss:

On August 1, 2012, defendant RANDY W. GOLDBERG pled guilty to the charges listed below. Any remaining counts will be disposed of at the time of sentencing. As a result of the guilty plea, there will be no trial involving this defendant.

Past, present, and future scammers will be following it closely too, and if the sentence is light, it will embolden them to step it up a notch.

The outcome of the August 20th Trial with Brandi Aycock resulted in a Hung Jury. As a result, a new Trial Date has been set to begin on October 25, 2012.

On September 12, 2012, a jury returned a not guilty verdict involving defendant BRANDI C. AYCOCK. The burden of proving a criminal case "beyond a reasonable doubt" is a difficult one. We vigorously prosecuted this case to the best of our ability within the framework of our criminal justice system.

The following verdict(s) were returned:
1 [charge of] Fraud by Wire, Radio, or Television [resulted in the verdict of] Not Guilty

Such a shame.
I remember recently the Peterson Jury in Chicago had to ask what "Unanimous" meant. Now the teachers up there are on strike.
Does it really mean anything, well to me it does, we are losing the battle not only to the criminals but also to the politicians. Either one of them can screw you over pretty good. We need to demand accountability for all of the money we spend on them. As AC White recently wrote in an article.
Currently, the Federal Motor Carriers Safety Administration has six investigators to oversee 4,400 moving companies, thousands of complaints and more than 2 million interstate moves a year.


With a budget of 606 Million we are just fools being fleeced.

While I'm getting progressively disappointed in the sentences being handed down, Brandi's probation shows that even if you are not actively cheating someone through sales and/or operations, just being there and not stopping it can still get you a criminal record.

You might want to check that again. I looked it up on the OIG website and it states something different. Do not know what the disconnect is though.

Summary

On September 28, 2012, a superseding information was filed in U.S. District Court, San Jose, California, charging Brandi Aycock, sales manager for National Moving Network (NMN), a Miami based household goods broker, with charges associated with the failure to observe published moving tariffs. Ms. Aycock subsequently pled guilty to the charges, and the court sentenced her to serve six months of probation, and ordered her to pay $10,765 restitution to two NMN victims and a $25 special assessment fee.

In 2003, OIG began investigating owners and employees of AY Transport, a household goods moving company based in San Jose, California. As part of its daily business practice, NMN booked moves nationwide and then referred a majority of the moves to AY Transport. AY Transport then charged customers fees above and beyond NMN published tariff rates.

Ms. Aycock admitted that from early 1999 and continuing through April 2005, she learned that AY Transport was willfully charging fees above and beyond published tariffs on moves booked by NMN. After learning this, she still continued to provide estimates to customers who then had their rates substantially increased by AY Transport. Furthermore, she knew that at least two customers were deprived of their goods until they paid the increased price.

OIG has been investigating this case jointly with the Federal Bureau of Investigation and Internal Revenue Service, with assistance from the Federal Motor Carrier Safety Administration.
